Terms of Service

These Terms of Service ("Terms") govern your access to and use of Truewidgets (the "Service"), provided by Loom Factor Limited ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you are authorised to bind that business.

1. The Service

Truewidgets lets you collect and display your business reviews in embeddable widgets, and — where you connect it — work with your Google Business Profile: reply to its reviews, see how it is doing, and put posts and services on it that you write or approve. We may add, change, or remove features over time.

Truewidgets is an independent service. It is not affiliated with, sponsored by, or endorsed by Google. Google, Google Maps and Google Business Profile are trademarks of Google LLC. Google Business Profile itself is free from Google: our plans pay for the Service, never for your profile. See Google's tips for working with a third party.

Nothing about a business is shown publicly (its review link, QR code, reviews page or widgets) until you show it's yours: by connecting its Google Business Profile with a Google account that manages it, or, for a business that isn't on Google, with a code on its website or an email at its website's domain.

2. Your account

• You must provide accurate information and keep your credentials secure.
• You are responsible for all activity under your account.
• You must be at least 16 years old and able to form a binding contract.

3. Acceptable use

You agree not to:

• connect or manage a Google Business Profile or other listing you do not own or are not authorised to manage;
• add, verify, or show reviews for a business you do not own or are not authorised to represent, or pretend to be any person or business;
• post false, misleading, unlawful, or infringing content, or manipulate or fabricate reviews;
• offer anything in return for reviews, ask only happy customers for them, or ask customers to use particular words in them;
• misuse, scrape, overload, reverse-engineer, or attempt to gain unauthorised access to the Service;
• use the Service to violate any applicable law or any third-party terms (including Google's).

4. Third-party services

The Service integrates with third parties such as Google, Stripe and Wix. Your use of those integrations is also subject to their terms and policies, and we are not responsible for third-party services. Google Business Profile data is handled as described in our Privacy Policy.

Google Maps. Parts of the Service — the business search in our website's demo, and Local ranking in your dashboard — use Google Maps features and content. By using them you agree to be bound by Google's Terms of Service and the Google Maps/Google Earth Additional Terms of Service, and the Google Privacy Policy applies.

5. Plans, billing & cancellation

• Paid plans are billed in advance on a recurring (monthly or annual) basis through Stripe until cancelled.
• If you use Truewidgets Reviews on a Wix site, Wix bills you for it instead, under Wix's terms, and you change or cancel the plan in your Wix dashboard.
• You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period.
• Fees may change with prior notice.
• A free plan is offered as-is and may change over time.

Except where required by law and under the promise below, payments are non-refundable. Payments made through Wix follow Wix’s refund policy.

Your reviews on your site, or your money back. If you pay for a plan on truewidgets.com and we can’t get your reviews showing on your website, even with our free setup help, we’ll refund that payment in full and end the plan. Tell us at hello@truewidgets.com within 30 days of the payment.

6. Your content

You retain ownership of the content and business data you provide. You grant us a limited licence to host, process, and display it solely to operate and provide the Service to you.

7. Intellectual property

The Service, including its software, design, and branding, is owned by Truewidgets and protected by law. These Terms do not grant you any right to our trademarks or to copy or resell the Service.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that cached third-party data (such as reviews) will always be current.

9. Limitation of liability

To the maximum extent permitted by law, Truewidgets will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. On termination, the rights granted to you end and we may delete your data as described in the Privacy Policy.

11. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and update the "Last updated" date; your continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Truewidgets is established, without regard to its conflict-of-law rules, and the courts of that jurisdiction will have exclusive jurisdiction, except where mandatory local law provides otherwise.
